Speakers:  Nicholas ‘Nick’ Simpson, Principal, [email protected]  and                                                                Elena Roper, Associate, [email protected]

A summary of the new and notable federal and Illinois employment laws that have gone into effect in 2025, a refresher on select employment laws affecting all workplaces, and recommendations for employer compliance and implementation going forward.

Presentation Goals/Key Takeaways:

    1. Provide overview of the new or amended IL employment laws employers should be aware of, including:

                                                              i.      IL Human Rights Act – amended to extend the deadline for employees to file discrimination charges (from 300 days to 2 years) and to add reproductive health decisions and family responsibilities as protected categories;

                                                             ii.      Pay Transparency – an amendment to the Illinois Equal Pay Act of 2003 that now requires employers to provide pay scale and benefits information in job postings;

                                                           iii.      IL Personnel Records Review Act – amended to expand the information and documents current or former employees may request from their employer; and

                                                           iv.      One Day Rest in Seven Act – amended to include anti-retaliation provisions and an enforcement mechanism.

    1. Provide overview of new or amended federal employment laws, including:

                                                              i.      FLSA – 2024 DOL Rule that increased the white-collar employee salary threshold to qualify for FLSA exemption is currently not in effect and will likely remain that way;

                                                             ii.      Title VII – aftermath of the Supreme Court’s Muldrow ruling, which held employees do not need to allege “significant” harm to establish unlawful discrimination; and

                                                           iii.      Diversity, Equity, and Inclusion – defining what is “illegal DEI” vs. “Legal DEI” under federal law.

    1. Provide refresher of IL and federal workplace laws and common employer missteps, including:

                                                              i.      The Pregnant Workers Fairness Act; and

                                                             ii.      IL Wage Payment and Collection Act – how to track nonexempt and exempt employee hours worked.

    1. Practical solutions for implementing and complying with these laws.
